DePuy ASR Lawsuits Move Forward in New Jersey, With Scheduling of Next Case Management Conference, Bernstein Liebhard LLP Reports

DePuy ASR lawsuits (http://www.depuy-asr-hip-recall.com/) stemming from the 2010 DePuy ASR hip recall continue to move forward in courts throughout the U.S., Bernstein Liebhard LLP reports. According to court documents filed in New Jerseys Bergen County Superior Court, the next Case Management Conference in the multicounty litigation established for DePuy ASR recall claims has been scheduled for November 21, 2013 at 11:00 a.m. Just over 650 DePuy ASR lawsuits are pending in the New Jersey proceeding. DePuy ASR Recall Litigation

Court documents indicate that more than 11,500 DePuy ASR lawsuits have been filed in courts around the country since the metal-on-metal hip implants were recalled in August 2010. More than 8,300 of these claims are pending in the federal multidistrict litigation underway in U.S. District Court, Northern District of Ohio. That litigations first bellwether trial was scheduled to begin in September, but was postponed for up to 90 days. It has yet to be rescheduled. (In re: DePuy Orthopaedics, Inc. Earlier this year, trials for DePuy ASR lawsuits did commence at the state court level. In March, a plaintiff was awarded more than $ 8 million after a Los Angeles Superior Court jury found that the hip implant was defectively designed. (Kransky v. DePuy, BC456086, California Superior Court, Los Angeles County) However, a jury in Chicago found for Johnson & Johnson in a second trial just one month later. (Strum v. Court documents filed in Californias San Francisco Superior Court indicate that a settlement was reached last month that resolves claims in the DePuy ASR lawsuit that had been selected for that state litigations first bellwether trial. The terms of the settlement have not been disclosed. (Ottman v. Johnson & Johnson Services, et al., No. CGC-12-517391;Calif. Super. Ct., San Francisco Cty.)

According to a recent report from Bloomberg.com, several other important trials are scheduled to begin in the next several months in DePuy ASR recall litigations underway in Illinois, Florida and California.*
